The Promotion of Access to Information Act, 2 of 2000 (‘PAIA’) was enacted to give effect to the constitutional right of access to information and gives a requester the right to lodge a request for information with the information officer of a private body.
In terms of PAIA, all private bodies are required to have a PAIA manual which details, amongst other things, the process to be followed when requesting information from the body. Initially, financial services providers with less than 50 employees and an annual turnover of less than R30 000.00 were exempt from this requirement.
This exemption will come to an end on 31 December 2020. You must therefore compile and submit a PAIA manual to the South African Human Rights Commission (‘SAHRC’) before 31 December 2020.
If your FSP already has a PAIA manual in place, which has been submitted to the SAHRC, please ensure it is made available on your website.
