The Financial Sector Conduct Authority (FSCA) has published a Request for Information (RFI) on crypto asset-related activities performed by financial services providers (FSPs), entailing the completion and submission of an electronic survey to the FSCA.
It is the stated objective of the FSCA to bring crypto assets, and thus crypto asset service providers, into the South African regulatory purview. The purpose of the RFI is to assist the FSCA in better understanding the extent to which FSPs are currently operating in the crypto asset environment and make more informed decisions regarding the potential future regulation of crypto asset-related activities.
In terms of section 131 of the Financial Sector Regulation Act, 9 of 2017 (FSRA) the FSCA may, by written notice, request a person to provide specified information that is relevant to assisting the FSCA to perform its functions in terms of a financial sector law.
All FSPs must comply with such a request!
